1. About WhatPaw

WhatPaw provides pet-related products and services, which may include pet identification tags, pet accessories, pet profile tools, QR code services, and related features.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.

2. Eligibility

By using our Services, you represent that:

  • you are at least the age of majority in your province, state, or country of residence, or

  • you are using the Services with the permission and supervision of a parent or legal guardian

You agree to use the Services only for lawful purposes and in accordance with these Terms.

Because some products may be handmade, customized, or photographed under different lighting conditions, slight variations may occur.

5. Orders

When you place an order through our Website, you agree that:

An order confirmation email does not necessarily mean that we have accepted your order. We reserve the right to refuse, cancel, or limit any order for reasons including but not limited to:

  • issues with payment authorization

  • shipping limitations

  • incorrect customer information

If we cancel an order after payment has been made, we will issue a refund of the amount paid, unless otherwise required by law.

All prices displayed on the Website are shown in the currency indicated on the Website unless otherwise stated.

Prices do not include applicable taxes, duties, customs charges, shipping charges, or handling fees unless explicitly stated otherwise. These amounts may be added at checkout depending on your shipping destination and applicable law.

Estimated shipping times shown on the Website are provided for convenience only and are not guaranteed unless explicitly stated otherwise. Delivery times may vary due to carrier delays, customs processing, weather, remote destinations, holidays, inaccurate address information, or other circumstances beyond our control.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed deliveries, or additional shipping costs caused by incorrect or incomplete address information provided by you.

Risk of loss and title for physical products pass to you upon delivery to the shipping address provided in your order, or as otherwise required by applicable law.

10. Untracked Shipping

If you select an untracked or economy shipping method, you acknowledge and agree that:

  • tracking updates may not be available

  • delivery times may be longer or less predictable

  • once the item has been shipped, limited proof of delivery may be available

To the fullest extent permitted by law, WhatPaw is not responsible for delays, loss, or non-delivery claims relating to untracked shipping once the order has been properly dispatched, except where otherwise required by applicable law.

11. Customs, Import, and Cross-Border Orders

For orders shipped outside Canada, or cross-border shipments, customs procedures and import requirements may apply.

The customer is responsible for understanding and paying any duties, taxes, brokerage fees, clearance fees, import charges, or related costs imposed by the destination country, unless expressly stated otherwise on the Website.

We are not responsible for delays, refusals, seizures, or extra charges caused by customs authorities or import regulations.

12. Returns, Refunds, and Cancellations

Our return, refund, and cancellation practices may be described in a separate Refund Policy or Shipping Policy posted on the Website. If a separate policy exists, it forms part of these Terms.

Unless otherwise stated:

  • personalized, customized, engraved, or made-to-order items may not be refundable or returnable unless they arrive damaged, defective, or incorrect

  • return requests must be made within a reasonable period after delivery

  • returned products must be unused and in their original condition unless the item is defective or incorrect

  • original shipping charges are generally non-refundable unless required by law

We reserve the right to deny a refund or exchange if the returned item does not meet the applicable return conditions.

Order cancellation requests must be made as soon as possible. Once an order has entered production, customization, packaging, or shipment, cancellation may no longer be possible.

13. Pet Information and QR Code Features

If our Services allow you to create pet profiles, upload pet information, or connect a QR code to a pet tag, you are solely responsible for the accuracy, legality, and appropriateness of the information you provide.

You acknowledge that:

  • only the information you choose to display should be visible through public scanning or public-facing features

  • you should not include sensitive information unless you are comfortable sharing it in the way the feature is designed

  • WhatPaw does not guarantee that a lost pet will be found or returned through the use of a tag, profile, or QR code feature

These features are provided as helpful tools only and do not constitute a guarantee of pet safety, location, recovery, or emergency response.

14. User Content

If you submit reviews, comments, photos, pet profiles, suggestions, or other content through the Services, you grant WhatPaw a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute such content for the purpose of operating, promoting, or improving the Services.

You represent that you have the right to submit such content and that it does not violate any law or the rights of any third party.

We reserve the right, but not the obligation, to remove or refuse any content that we consider unlawful, offensive, misleading, infringing, harmful, or otherwise inappropriate.

15. Prohibited Uses

You agree not to:

  • use the Services for any unlawful or fraudulent purpose

  • interfere with or disrupt the Website or its security

  • upload malicious code, viruses, or harmful material

  • scrape, copy, or exploit Website content without authorization

  • pet identification or recovery features will prevent loss or guarantee recovery

Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded under applicable law.

18. Limitation of Liability

To the fullest extent permitted by law, WhatPaw, ICS Enterprises LTD., and our directors, officers, employees, contractors, affiliates, service providers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity, or business arising out of or related to your use of the Services or purchase of products.

Our total liability for any claim arising out of or relating to the Services or any product purchased through the Website shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.
